Collection of 2020 Social Security Tax Deferral

New legislation has extended the timeline for members of the NH Air National Guard paying back deferred 2020 Social Security taxes.

The Consolidated Appropriations Act, 2021, was passed and extended the period for collection to Jan. 1 through Dec. 31, 2021 (instead of Jan. 1 to April 30, 2021).

Key Points:

Civilian Pay – Begin collections as planned, beginning with Pay Period End (PPE) 1/16/2021 and collected in even amounts over 24 pay periods, ending with PPE 12/4/2021.

Military Pay (Active Component/AGRs) – Begin collections as planned with January min-month disbursement and collect in even amounts over 24 increments (12 Mid-Month and 12 End of Month collections).

Military Pay (Reserve Component/Drill-Status Guardsmen) – Begin collections with the January mid-month disbursement to be in alignment with Active Component and to ensure time for programming and testing in advance of collections.  Collections will be at 2 percent of pay until the full deferral has been collected from the member.

Members who separated or retired before Dec. 4, 2021, and prior to the deferred Social Security tax being collected in full, bear responsibility for paying the remainder of their deferred Social Security taxes. The unpaid balance will be collected from the final paycheck. If there are insufficient funds to collect the full amount, the member may receive a debt letter with instructions for repayment.

Background:

Pursuant to IRS Notice 2020-65 and at the direction of the Office of Management and Budget and Office of Personnel Management, Social Security (Old Age, Survivors, and Disability Insurance) or "OASDI" tax withholdings were temporarily deferred from September through December 2020 and will be collected from wages paid between January 1, 2021 and December 30, 2021, for employees who had wages subject to OASDI of less than $4,000 in any given pay period.  These actions were in response to the Presidential Memorandum issued on August 8, 2020.
